This article is the result of a research about the way the Constitutional Court has solved the constitutional problem concerning the special systems for admission to state universities. The problem took to the reconstruction of the jurisprudential line of the Court based on the method for the dynamic analysis of jurisprudence. The article shows that the debate about the special systems for admission to the universities should determine what is university autonomy, right to equality, and rules for access to the education. Furthermore, the article proposes that the debate must take into account the new normative regulations around the admission of groups with special conditions to educational institutions, in order to obtain and consolidate the real accomplishment of the right to equality
