The problems of the effectiveness of fundamentalrights and the superior interest of the childare reviewed in the light of cases in which childrenface legal figures of preferential loans andembargoes. A formal exposition of the problemis submitted, norms of International and ConstitutionalLaw regarding the superior interest ofthe child are analyzed as well as their legal consecrationand application. Finally, some criticalconsiderations are presented based on the jurisprudentialdevelopments by the ConstitutionalCourt in regard to this matter.
