El presente artículo tiene como objetivo mostrar la importancia que posee la participación, es decir, la incidencia de las comunidades en el proceso de asignación de nuevos derechos, en la transición de un Estado social de derecho hacia un Estado ambiental de derecho. En este sentido, a través del mismo se evaluará la idoneidad de los principales mecanismos de participación ambientalpara configurar o proponer la identificación de nuevos sujetos de derecho, y su respectiva asignación de valores para su respeto y protección. Para ello se efectúa un breve análisis de la forma como han sido entendidos estos conceptos, tanto desde la jurisprudencia emanada de la Corte Constitucional colombiana, como desde la doctrina. De igual manera se aborda como temaprincipal, la participación en la gestión ambiental como instrumento quepermite la construcción colectiva del devenir del país, teniendo en cuentalos derechos como otras maneras de ver el mundo y el desarrollo. Así, endefensa de la vida, estos escenarios toman en cuentan otros valores parala pervivencia en el planeta.
The main purpose of this paper is to analyze the transcendence of the participation in the communities assignment process of new rights, ina transition of the Social Rule of Law to an Environmental Rule of Law.In order to achieve this objective, This paper pretends to study thesituation of the main mechanisms of environmental participation in whichthis concepts has been considered in the jurisprudence of the Colombia’sConstitutional Court, as well as in the doctrine. Moreover, it addresses theparticipation in the environmental management as an instrument thatallows a collective construction of the future of the country, bearing in mind not only the right of persons, but also others perspectives of the world and the development. In this order of ideas, these scenarios considerer other important values for the continued existence in the planet.
