El artículo presenta una aproximación a la figura de la amnistía desde la perspectiva del derecho internacional. Con este fin, se parte de la identificación de casos en los sistemas interamericano, europeo y africano, en los que se han promulgado leyes de amnistía dentro de ordenamientos nacionales. Posteriormente se revisa el tratamiento a partir de instrumentos internacionales y se estudian decisiones de tribunales sobre este tipo de normativas. Este trabajo constituye una herramienta para conocer, desde la responsabilidad colectiva de los Estados y la responsabilidad internacional del individuo, el tratamiento que se da a la figura de la amnistía.
This paper offers an approach to the issue of amnesty from an international law perspective. With this aim, it begins with the identification of legal cases in the Inter-American, European, and African systems, in which amnesty laws have been enacted within national legal systems. It continues with the verification of the way in which international instruments deal with this type of law, as well as the study of decisions of international tribunals in this matter. It constitutes a tool that helps to understand the treatment that international law gives to the topic of amnesty, from the point of view of the collective responsibility of states, and of individual international responsibility.
