En este artículo de reflexión se hace un análisis del papel del Comité de Protección de los Derechos de Todos los Trabajadores Migratorios y de sus Familiares, como mecanismo convencional en la reivindicación de las garantías de estas personas. A su vez, se plantea la importancia de la Observación General n° 1 de este Comité, con el propósito de examinar si dicho pronunciamiento contribuye o no al desarrollo progresivo de los derechos de los trabajadores migratorios y sus familias. La investigación fue dogmática y cualitativa y se llegó a la conclusión que a pesar de que la actividad del Comité en la interpretación de la CTMF es incipiente, la Observación General motivo de estudio puede evidenciar interesantes aportes. No obstante lo anterior, es un reto para el Comité abordar la gran cantidad de temáticas que rodean esta realidad, y asumir una actitud más contundente frente a los Estados, en beneficio de los derechos de los trabajadores migrantes.
In this reflexive article an analysis of the role of Committee on the Protection of the Rights of all Migrant Workers and Members of Their Families, as a conventional mechanism in these people guarantees revindication is done. At the same time the importance of the n°1 General Comment (GC) of this committee is discussed with the purpose of its examination, to determine if the say so GC contributes or not to a progressive development of the rights of migrant workers and their families. The investigation was dogmatic and qualitative and concludes that; despite the activity of the committee regards to the interpretation of the CMW is incipient, the GC as matter of study gives evidence of interesting contributions. Nevertheless, the discussion of the great amount of subject matters that surround this reality is a challenge for the committee as so it is to take a decisive posture before the different States in benefit of the rights of migrant workers.
